Amendments to be moved in committee (on recommitment)
This briefing sets out our concerns in relation to some of the Government amendments tabled on 8th June, 2004, namely: (Extracts shown below)
- Failed asylum seekers: accommodation
This amendment seems to us to be in contravention of the European Convention of Human Rights article 4.2 which states
'No one shall be required to perform forced or compulsory labour'
- Accommodation of asylum seekers: local connection
We invite the Government to explain how this position can be reconciled with Article 8 of the European Convention of Human Rights (the right to private and family life) and Article 26 of the 1951 Refugee Convention on freedom of movement
- Refugee: back-dating of benefits
We consider that this provision contravenes Article 23 of the 1951 Refugee Convention on public relief
- Integration loan for refugees
From our experience, we believe asylum seekers are unlikely to take up loans and risk indebtedness. Finally would the costs of administering such a scheme outstrip that involved in making the backdated payments?
- Person subject to immigration control: procedure for marriage
„h It is a human right defined in Article 12 of the European Convention of Human Rights to be able to marry. Currently European law means that EU nationals do not have to get permission or pay fees to marry.
